Change of the Seat of Arbitration Due  to Substantial Change of Circumstances: Myths and Reality

This unique event offers an immersive exploration of a timely and complex issue in international arbitration: the change of the seat of arbitration due to a substantial change in circumstances.

Moving beyond traditional presentations, we'll show a mock arbitration proceeding centered around a fictional dispute where this critical question arises. A panel of distinguished arbitrators will dissect the legal and practical implications of such a change.

Detailed program:
•   2:00 PM - 2:20 PM: Networking and Registration

•   2:20 PM - 2:35 PM: Introduction and a case outline, provided by the moderator Izabella Prusskaya (PBLA)

•   2:35 - 3:05 PM: Setting the Scene: Arguments for and Against Changing the Seat

•   Hear compelling opening statements and initial arguments outlining the points of view for and against changing the seat of arbitration due to unforeseen circumstances. The speakers will explore the legal basis for such a change, the potential impact on the arbitration process, and the parties' rights.

•   The Arbitral Tribunal will engage in a dynamic discussion, dissecting the arguments presented by both sides. The arbitrators will delve into the myths and realities surrounding changing the seat of arbitration, exploring key legal issues such as force majeure, frustration of contract, and the inherent powers of the tribunal. Audience members are encouraged to engage in a Q&A session with the arbitrators. This will allow audience to gain valuable perspectives on the complex considerations arbitrators face when deciding whether to change the seat.

45th ICC Institute Annual Conference on Monetary Remedies in International Arbitration The ICC Institute of World Business Law’s 45th Annual Conference is taking place in Paris on Friday 14 November 2025! This year's theme is Monetary Remedies in International Arbitration. This full-day conference will examine how monetary remedies are assessed, argued, and awarded in international arbitration. Drawing on diverse legal systems and practical experience, panels will address foundational principles, contractual remedies, long-term arrangements, and emerging areas such as environmental and competition law damages. Speakers will explore key distinctions, such as direct vs indirect loss, liquidated damages, and hardship claims, and provide insights into arbitral discretion in awarding costs and interest. A debate-style closing panel will critically assess the evolving role of experts, featuring opposing views, war stories, and interactive discussion. Designed for practitioners, counsel, experts, and arbitrators, the event offers practical takeaways and a clear view of current trends shaping damages in arbitration today. This 45th edition will see the Laureate of the bi-annual ICC Institute of World Business Law Prize announced, followed by a celebratory cocktail reception after the conference.  All participants will receive a digital copy of the Dossier XXIV of the Institute Series, summarising the day’s discussions.

This panel will (1) explore the perspectives of key stakeholders—supported where possible by data—to identify the principal choke points in proceedings; and (2) discuss practical solutions to common sources of delay, including case management strategies and potential institutional reforms, to improve efficiency while preserving the integrity of the arbitral process.

The Campaign for Greener Arbitration (CGA) is a community initiative to reduce the environmental impact of international arbitrations. The CGA is centred around a 'Green Pledge' of commitments taken by arbitration practitioners and stakeholders to drive sustainable change.

Join us for an implementation focused evening which will introduce the CGA’s Implementation Task Force and the wealth of CGA resources developed to help practitioners embed the Green Pledge in their daily practice. A cross sector panel of seasoned stakeholders — from law firms, institutions, chambers and service providers — will share their experiences and lessons learned when implementing the Pledge.
